Now people can freely exchanges their words to their loved one via messages whether day or night, without bound on limit of SMSs.
On all the Mobile SIM, there had 200 per day SMSes restriction for personal communication, but on Friday, Delhi High Court Friday quashed this limit, saying such curbs infringe the freedom of speech of the citizens.
According to reports, a bench of justice said that the restriction on the daily SMS limit was completely justified for UCCs (unsolicited commercial communication), and the 200 per day SMSes imposed by the Telecom Regulatory Authority of India in the present form as it exists was violative of the constitutional provision, a “reasonable restriction” under Article 19 (2) infringed the “equally” important right to privacy of “unwilling recipients.”
“While upholding this provision qua UCC i.e. commercial calls, the same is set aside insofar as it covers non-UCCs SMS also,” the bench said, as per source report.
“We have already pointed out that the Trai has found that UCC calls and SMSes were interfering with the personal lives of the individuals as often telemarketers would call them up for selling their products, that the receiving party does not want to receive,” it further added.
UCC messages disturb the citizens, interfare their privacy, putting cost in terms of the time, irritation and efforts.
Anil Kumar, secretary of NGO Telecom Watchdog, filed a petition and partially allowed on it, the court said, Regulations were framed to keep the aim of curbing the menace of UCC calls and SMSes, but regulator was not reasonable in “painting with the same brush” SMSes for commercial advertisements that breach fundamental rights of the users.
